September Online CPD 2020 – Inheritance (Provision for Family and Dependents) Act 1975

This month’s CPD will detail the Inheritance (Provision for Family and Dependents) Act 1975 “the 1975 Act”, who can make a claim under the Act, and what criteria the Courts will have regard to when considering such a claim. The Act received much media attention in 2017 following the case of Illott v Mitson where an adult child of a deceased testator made an application under the Act for provision after her estranged mother’s Will failed to make provision for her, instead opting to leave her estate to four animal charities.
