‘This month’s CPD will detail the Inheritance (Provision for Family and Dependents) Act 1975 “the 1975 Act”, who can make a claim under the Act, and what criteria the Courts will have regard to when considering such a claim. The Act has received much media attention recently following the case of Illott v Mitson where adult child of a deceased testator has made an application under the Act for provision after her estranged mother’s Will failed to make provision for her, instead opting to leave her estate to four animal charities.’
