Induction Course – Taking Good Instruction 2 day
This course is now in its ninth successful year and each year
more and more students are signing up to this course as a
‘fast-trak’ entry into the profession and the Society. Its title
really does not do the course or the tutors that give it justice. As
we say “Only by taking good clear instructions can you ever hope to
produce a clear and unambiguous Will which reflects the clients
wishes”.
Today with more complex families, greater wealth and more couples
living together but not married the ability to give the correct
advice and to draft a Will that reflects the testator’s
circumstances is paramount. Simply taking instructions is no longer
an option.
Although it is possible to draft a Will using a variety of text
books, this method of “cutting and pasting” or simply copying is
fraught with danger, and in many cases the finished document can
look like a cobbled together list of clause with no interaction or
flow or worse a missing word or phrase could alter the entire
destination of the estate.
The course covers the Law of Succession, intestacy, how Wills work
and how Wills fail – we highlight the traps that one can easily fall
into or be drawn into.. We will take you through the maze of
understanding capacity, the Mental Capacity Act 2005, the Children’s
Act, how, why and who to appoint as executors and trustees –
professional –v- laypersons, how gifts are made and why they fail
and much, much more.
That was just the first morning; the afternoon starts by introducing
you to Trusts, discretionary, pecuniary, protective, disabled
persons as well as property trusts and life tenants. How we can use
effectively the family home to protect against long term care fees
or against the surviving spouse or partner remarrying and protecting
your children’s entitlement. We will look trusts especially for
children and also business trusts and business reliefs as well as
inheritance tax planning.
The fee for the course covers the two days, all refreshments and
lunches, notes and the exam.
This course is a quick and easy way; although intensive, into the
profession and many students go on to take the Certificate Course
Part One to develop their knowledge further.
An examination follows the course in the form of an open book exam
and can be taken at a time and place of your choosing but that date
must be advised to the College prior to the chosen date in order the
exam papers can be sent to you in good time.
